As LuvByt, we strive to operate according to the consumer protection act of South Africa. LuvByt online store should be used in line with all the terms & conditions stated below.
If you click the box next to “I have read and agree to the website’s terms and conditions” at the checkout page, it means that you agree to everything we have set in our terms.
We encourage all our website users to read through different sections of our terms, especially those that are important to them. If you don’t take time to familiarize yourself with our terms; please do not use our service or order from this website.

1. REGULAR UPDATES & CHANGES
- a) Luvbyt will amend and update these terms & conditions from time-to-time.
- b) Every time we make changes, we will also update the publication date of our terms.
We encourage you to carefully read through the updated sections of our terms, because every term is a legally binding agreement between yourself and LuvByt.
2. PEOPLE WHO USE OUR WEBSITE
- a) All the people who use our website are required to read and understand our terms before making any purchase. People under the legal age of 18 are only allowed to browse, but not purchase.
- b) Website users who are residing outside of South Africa are welcome to use our website, provided they are in agreement with our terms.
3. DELIVERIES
- a) We have dedicated 3 days a week to perform our deliveries – Mondays, Fridays & Saturdays.
- b) Our standard delivery period for areas within or near Johannesburg and Pretoria Central ranges from 24 hours to 4 days of delivery. Clients within the cities can get their deliveries within 24 hours and 2 days for those who are near the city.
- c) The further you are away from the city; you will get your delivery within 5 days.
- d) Remote and regional areas outside Gauteng will get their deliveries within 5-8 days, or even earlier.
- e) Please contact us to confirm the estimated delivery time.
- f) The delivery schedule applies to fresh fruits, vegetables & other perishable goods.
- g) Other grocery items might take 3-6 days to deliver. Every time you place an order, we will provide you with the estimated delivery time.
- h) We will update you if there is a delay and ask for an extra day or two. If we delay further, you are free to cancel the order for a refund or credit.
- i) Depending on your distance & what you order, our delivery fee will range from 5-35% of the item value. Delivery fees can be transferred separately or paid in cash to our delivery people.
- j) Depending on what items you order, some deliveries will be free.
4. MINIMUM ORDER (MOQ)
Our minimum order value per delivery is R200.
5. RETURNS POLICY
Health, safety & freshness are our highest priority. We always inspect our items before they are packed for your delivery. Due to health and safety concerns, we can only exchange fresh food items if they are not fresh, but not if you have changed your mind after the food has been delivered to you. We can exchange the returned products if they are damaged or not in their original form during delivery.
If the items are returned after the prescribed period, then you will not be eligible for refund, credit or exchange.
5.1 Discounted Items:
- a) Discounted items with a value over R1000 must be returned within 5 days.
- b) Items with a clearance sale of 50% must be returned within 24 hours.
- c) No discounted items will be eligible for exchange or refund, especially if they are in perfect condition.
5.2 Delivery Fees
We do not refund or credit any delivery cost, hence we always strive to deliver the correct items.
5.3 Fresh Fruits & Veggies
- a) If it happens that you have purchased any food item that is not fresh or has expired, kindly ask the driver to return with the delivery.
Pictures in the website are for demonstration purposes, and this does not mean that you will get the exact fruits & vegetables supplied in their exact shape, size, color or texture. All we can guarantee you is that we always deliver fresh fruits and vegetables in their correct quantity.
- b) We only accept returns of fresh produce within 24 hours.
- c) We always make our customers aware of items that have about 7 days expiry date or have slight/minor damages. Those items will be sold at a clearance price of 50% off, and they will not be accepted for returns & refunds.
- d) We carefully inspect fresh produce items before it is delivered to you. If you accept our delivery, it means that you appreciate the freshness of our fresh produce.
- e) If it happens that you experience anything wrong with our fruits and vegetables, please send us pictures or videos within 24 hours of delivery.
- f) The food items will then be replaced within 2 days – If you cannot manage to wait for replacement items, you are welcome to cancel the order so that you can be refunded or credited for future purchase.
5.4 Fresh Fish & Poultry
- a) These items should be reported within 24 hours, and they will be replaced within 2 days.
- b) If you cannot afford to wait for our replacement, you can either get a refund in 7 days or be credited for your next purchase.
5.5 Processed Meats
- a) All our processed foods are printed with their production & expiration dates.
- b) If it happens that you pick up anything that will expire within the next 40 days, you can inform us within 5 days if you are not planning to consume it in the next 14 days.
- c) The returned product should be fully sealed in its original packaging. The replacement will be delivered to you in 3-5 days.
5.6 Snacks
If you taste any staleness of our snacks within 2 days of delivery, please contact us immediately.
5.7 Kitchen Accessories
- b) We perform a thorough inspection on our kitchen goods in order to avoid the costly inconvenience of having to exchange the goods.
- b) If you have purchased any kitchen accessory items that are defective due to factory fault, you may notify us within 14 days so that we can arrange for your replacement within 7 days.
- c) In instances where products don’t have any defects, we accept their returns and exchange within 14 days, provided they are still in good condition & packaging to be sold to the next customer.
- d) You can either be credited or exchanged for items of the same value.
6. FORCE MAJEURE
- a) In the event that LuvByt is prevented from carrying out any of its obligations in terms of this Agreement, whether as a result of an act of God, industrial action of any kind, machinery breakdown, damage to or destruction or contamination of LuvByt’s warehouse packaging facility, any part thereof. Such events include fire, riot, war (whether declared or not), power and water outages or shortages, labor disputes, labor strikes, embargoes, import or export controls, international trade restrictions, any order by any local or international authority.
- b) Lubyt shall not be held accountable for inconveniences caused by such events, and you will not be held responsible if there are any returns you have to deliver to us within a specified time frame.
- c) A balanced agreement that favors both parties will then have to be reached within 30-60 days.
7. INDEMNITY
- a) You agree to indemnify us for and defend against any actions by third parties related to your participation in our program.
- b) For example, false claims & accusations that mislead the public, If you violate our anti-spam policy, and we get sued as a result of your activity, you must indemnify us for the damages and legal fees that you cause us to incur arising out of your breach of our Terms or your violation of any law or the rights of a third party.
8. DISCLAIMER
Any information presented on luvbyt.co.za is only for knowledge sharing purposes. This information should not be used in place of, or as a substitute for, professional medical advice, diagnosis, or treatment. As long as the website and the information and services on the website are provided free of charge, we will not be liable for any loss or damages of any nature.
9. VARIATION OF TERMS
luvbyt.co.za is permitted to revise these Terms at any time as it sees fit, and by using this Website you are expected to review these Terms on a regular basis.
10. ASSIGNMENT
luvbyt.co.za is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.
11. ENTIRE AGREEMENT
These Terms constitute the entire agreement between luvbyt.co.za and you in relation to your use of this Website, and supersede all prior agreements and understandings.
12. GOVERNING LAW & JURISDICTION
These Terms will be governed by and interpreted in accordance with the laws of South Africa, and you submit to the non-exclusive jurisdiction of the state and magistrate courts located in South Africa for the resolution of any disputes.
